Terms of service.

These Terms of Service ("Terms") govern your access to and use of Triumph (operated at praxis5001.com, "the service", "we", "us"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service. The short version: Triumph is an independent study tool, the question bank stays free, and the optional Pro subscription is billed by our payment processor.

1. The service

Triumph is an independent study tool for the Praxis 5001 (Elementary Education: Multiple Subjects). It provides a free practice-question bank, a readiness diagnostic, study guides, spaced-repetition review, and progress tracking. All practice questions are original works written against publicly published ETS test blueprints; no official test items are reproduced.

3. Free plan and Pro subscription

The core question bank, diagnostic, and study guides are free. A paid Pro subscription ($15/month) adds forecasting and planning features, including pass-probability tracking and early access to new Pro study tools. We may add or remove features over time; features are not part of the price except as described on the pricing page at the time of purchase.

Payments for the Pro subscription are processed by Creem, acting as Merchant of Record. That means Creem handles the payment card processing, applicable tax collection, and chargeback processing on our behalf. The secure checkout and the customer billing portal (where you can update your card or cancel) are hosted by Creem. We never see or store your full card details.

Because the diagnostic and much of the question bank are free, you can evaluate the service before subscribing. If you are not satisfied with a Pro subscription, contact us via the contact page or the support ticket system within 14 days of the charge and we will review a refund for that billing period. Where a refund is approved, it is issued through the same payment method used for the original charge, in accordance with our processor's rules. Requests made later than 14 days, or for periods that have already been used, are handled case by case. Nothing in this section affects any rights you have under applicable consumer law.

7. Content and intellectual property

All content on Triumph — including practice questions, explanations, study guides, code, and design — is owned by us or licensed to us and is protected by copyright and other intellectual-property laws. You receive a personal, non-exclusive, non-transferable license to use the service and its content for your own test preparation. You may not copy, scrape, republish, or sublicense the content except as explicitly permitted (for example, via the public API under its own terms).

No affiliation with ETS. Triumph is not affiliated with, endorsed by, or sponsored by ETS (Educational Testing Service). "Praxis" is a trademark of ETS. Any mention of ETS or Praxis is for identification of the exam only and does not imply endorsement. Nothing here grants you any rights in those marks.

8. Developer API and data

The developer API, MCP server, and markdown representations are provided for programmatic access to the question bank and site content. Use of the API is subject to the rate limits and key terms published on the developer page. Your data is handled as described in our privacy policy.

9. Disclaimers

The service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that practice results predict actual exam scores. Exam facts (question counts, timing, passing scores, fees) reflect ETS publications as of the stated dates and can change; always confirm current rules with ETS and your state licensing agency before registering.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or data, arising out of or related to your use of the service. Our total liability for any claim arising from the service will not exceed the greater of the amounts you paid us in the 12 months before the claim or $50.

You may stop using the service and delete your account at any time (see the privacy policy for how). We may suspend or terminate your access for violation of these Terms. Sections that by their nature should survive termination — including content/IP, disclaimers, limitation of liability, and governing law — will continue to apply.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where practical, notify you (for example, by email to your account address or a notice on the site). Continued use of the service after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which the operator is located, without regard to conflict-of-law rules. Any disputes will be resolved in the courts of that jurisdiction. If any provision is held unenforceable, the remaining provisions will continue in full force.
